Подходы к либерализации в соглашениях о свободной торговле услугами

Abstract

Рассмотрены подходы к либерализации международного торговли, используемые в соглашени¬ях о свободной торговле услугами: позитивный, негативный и гибридный. Показаны их основные отличия, включая особенности применения оговорок standstill и ratchet, а также режима прозрачности. Приведены особенности исходя из географической локализации и уровня развития стран – участниц соглашений. Отмечены негативные и позитивные черты. Проанализированы новейшие многосто¬ронние соглашения, использующие позитивный (ПАЦЕР плюс), негативный (ВПСТТП) и гибридный (РВЭП) подходы. Показаны их инновации в регулировании торговли услугами по сравнению с ранее подписанными соглашениями о свободной торговле между их странами-участницами. Сделан вывод о целесообразности выбора гибкого гибридного подхода в условиях цифровизации и появления новых, ранее не классифицированных, видов услуг.

Approaches to liberalization of international trade used in services free trade agreements are considered: positive, negative and hybrid. Their main differences are shown, including the features of using the standstill and ratchet clause, as well as the transparency mode. The features are given based on the geographical localization and the level of development of the countries participating in the agreements. Negative and positive features are noted. The latest multilateral agreements, using positive (PACER plus), negative (СPTPP) and hybrid (RCEP) approaches, are analyzed. Their innovations in the regulation of trade in services are shown in comparison with previously signed free trade agreements between their participating countries. The conclusion is made about the expediency of choosing a flexible hybrid approach in the context of digitalization and the emergence of new, previously unclassified types of services.
