Институт лицензирования как элемент разрешительной системы

Abstract

Проведен институциональный анализ разрешительной системы, выделены ее элементы; установлена правовая сущность лицензирования; исследована природа правомочий лицензиата; определено место лицензии в системе правовых актов управления; проведена классификация лицензий; сформулированы правила действия лицензий во времени, в пространстве и по кругу лиц; выделены стадии лицензионного производства и процессуальные особенности выдачи отдельных лицензий; разработаны концептуальные основы лицензионного контроля; установлена правовая природа мер принуждения, применяемых к лицензиату; предложены авторские определения понятий «разрешительная система», «лицензирование», «лицензия» и «лицензионный контроль»; внесены предложения по совершенствованию законодательства.

Institutional analysis of the system of permission has been conducted, its elements have been allocated; the legal essence of licensing has been determined; the nature of the powers of the licensee has been investigated; the place of license in the system of legal acts of executive power has been defined; classification of licenses has been done; the rules of action of the licenses in time, in space and in respect of persons have been formulated; stages of the procedure of licensing and procedural features of the licensing of separate licenses have been allocated; the conceptual basis of licensing control is developed; the legal nature of coercive measures, applied to the licensee has been determined; definitions of the author of «system of permission», «licensing», «license» and «licensing control» are proposed; proposals to improve legislation are made.
