Административное задержание: международно-правовой и национальный аспекты (по материалам Республики Беларусь)

Abstract

The article describes brief description of administrative detention as a special measure of administrative compulsion (through disclosure of its essence and functions) and as an institution of procedural-executive law of the Republic of Belarus (features of its legal rules in space, time and in a circle of persons). The article also presents prospects for improving of legal regulation of administrative detention of the Republic of Belarus (legal international and national aspects). In a concise and concentrated form their rationale is set in the article. Rationale is based on analysis of the existing rules of legislation of the Republic of Belarus and rules of a number of international treaties (universal). The perspectives (which suggested by the author here) can contribute to the development of the functioning of rule of law in the Republic of Belarus and further international respect for human rights. This article contains the main results of the scientific-legal research, which was conducted by the author (V. P. Sukhaparau) on the subject of the same name («Administrative detention: international-legal and national aspects (based on the materials of the Republic of Belarus)»).
