Гражданско-правовое регулирование отношений управленческого представительства

Abstract

Проведено комплексное научное исследование деятельности, которая осуществляется в формах прямого и косвенного представительства, уполномоченным (управомоченным) лицом, обладающим в силу различных оснований возможностью принимать решение по своему усмотрению; определено понятие «управленческое представительство»; уточнены образующие управленческое представительство свойства и связи в типичной системе норм и институтов; разработан комплекс мер по обеспечению интереса представляемых лиц; внесены конкретные практические предложения, направленные на совершенствование гражданского законодательства Республики Беларусь.

The findings of the research have revealed the complex research activity in the civil-law regulation that exists in the form of direct and indirect relations of civil legislation. Such a kind of civil representativeness involves the representative in charge who is empowered to make decisions on his own to be seen fit and appropriate for the person whose rights and interests are being represented. The definition of administrative offices has been formulated and developed by the author. Both the links and the features in a typical system of civil-law regulation in administrative offices have been clarified. The set of instructions to protect the civil rights of those who are being represented has been developed. The proposals for improving the current state of civil legislation in the Republic of Belarus in the field of legal regulation of executive type of relationship have been made.
