Проблемы дефинирования понятия юридических фактов

Abstract

Данная статья продолжает цикл публикаций автора о теории юридических фактов. В качестве цели исследования выступает решение важнейшего вопроса—выявление проблем, связанных с дефинированием понятия юридических фактов. Cреди них автор называет следующие: проблему адекватного понимания сущности юридических фактов; проблему согласования дефиници с типом правопонимания; проблему непонимания различия между понятием (категорией) юридических фактов, термином, обозначающим указанное понятие, и дефиницией указанного понятия; проблему небрежности в дефинировании понятия юридических фактов по причине обманчивой простоты названного понятия, недооценки практической потребности в общепризнанной дефиниции понятия юридических фактов, равно применимого ко всем нормативным массивам; проблему отсутствия теоретической обоснованности авторских определений юридических фактов и оторванности дефиниции от контекста иных авторских положений теории юридических фактов.

This article continues the series of the author’s publications on the theory of the legal facts. As the purpose of the study has been chosen an important issues—the identification of problems related to defining concept of the legal facts. Ranked among them, the author refers to the following: the problem of an adequate understanding of the essence of the legal facts, agreed with the selected type of law; the problem of misunderstanding the difference between the concept (category) of the legal facts, terminology for these concepts, and the definitions of this notion; the problem of negligence in defining the concept of the legal facts because of the deceptive simplicity of the named concept, underestimating the practical need for universally accepted definition of the concept «legal facts», that is equally applicable to all regulatory arrays, and the lack of theoretical validity of the author’s definition of the legal facts and the isolation of definition on the context of other author’s ideas of the theory of the legal facts.
