Понятие и элементы гражданско-правового статуса несовершеннолетнего

Abstract

Статья посвящена вопросам определения гражданско-правового статуса несовершеннолетнего. В белорусской юридической науке актуальным остается необходимость комплексного теоретического анализа данной темы. Целью работы является формирование определения понятия «гражданско- правовой статус несовершеннолетнего», выявление его основных элементов. Исследуются работы белорусских и российских ученых-юристов, посвященные данной проблематике; проводится разграничение понятий «правовой статус» и «правовое положение» личности; анализируются различные подходы к пониманию структуры правового статуса как личности в целом, так и ребенка в частности; обобщаются основные положения из научных трудов по данной теме, на основании чего автор делает определенные выводы, имеющие теоретическое значение.

The article deals with the issues of determining the civil status of a minor. There is an urgent need for a comprehensive theoretical analysis of this topic in the Belarusian legal science. The purpose of the work is to form a definition of the concept of “civil status of a minor”, to identify its main elements. This purpose is achieved within the framework of a comprehensive analysis of existing approaches to the consideration of the legal status of an individual. The works of Belarusian and Russian legal scholars devoted to this issue are being studied. A distinction is made between the concepts of “legal status” and “legal provision” of an individual. Various approaches to understanding the structure of the legal status of both the individual in general and the child in particular are analyzed. The article summarizes the main provisions from scientific works on this topic, on the basis of which the author draws certain conclusions of theoretical importance.
