Участие государственных органов и иных органов в судопроизводстве в контексте изменений гражданского процессуального законодательства

Abstract

В настоящей статье автором исследуются судебные разбирательства, когда помимо лиц, непосредственно заинтересованных в исходе дела, в суде по гражданским и экономическим делам участвуют государственные органы, иные органы и организации. Автор детально описывает, в каких случаях государственные органы могут обратиться в суд в защиту прав и интересов других лиц, сравнивая порядок участия данных субъектов в гражданском и хозяйственном процессах с учетом положений Кодекса гражданского судопроизводства Республики Беларусь. Автором выявлены проблемы в правовом регулировании участия государственных органов, иных органов и организаций в гражданском и хозяйственном судопроизводствах, а также в судебной практике. Автор раскрывает трудности, с которыми сталкиваются данные участники, такие как недостаток полномочий, сложность в защите прав заинтересованных лиц и проблемы с последующим исполнением судебных решений. В научной статье анализируются перспективы развития цивилистического процессуального законодательства в этой области, предлагаются возможные изменения и дополнения, которые будут содействовать повышению эффективности участия государственных органов, иных органов и организаций в судебных процессах, а также позволят повысить защиту прав и законных интересов граждан и организаций.

In this article, the author examines court proceedings when, in addition to persons directly interested in the outcome of the case, state bodies, other bodies and organizations participate in the court in civil and economic cases. The author describes in detail the cases in which state bodies can apply to the court to protect the rights and interests of other persons, comparing the procedure for the participation of these entities in civil and economic proceedings, taking into account the provisions of the Code of Civil Procedure of the Republic of Belarus. The author identified problems in the legal regulation of the participation of state bodies, other bodies and organizations in civil and economic proceedings, as well as in judicial practice. The author reveals the difficulties that these participants face, such as lack of authority, difficulty in protecting the rights of interested parties and problems with the subsequent execution of court decisions. The scientific article analyzes the prospects for the development of civil procedural legislation in this area, proposes possible changes and additions that will help to increase the effectiveness of the participation of state bodies, other bodies and organizations in court proceedings, and will also improve the protection of the rights and legitimate interests of citizens and organizations.
