Исчерпание исключительного права на товарный знак: история и перспективы развития законодательства Республики Беларусь и Российской Федерации

Abstract

Исследуются предпосылки, особенности и перспективы развития законодательства Республики Беларусь и Российской Федерации об исчерпании исключительного права на товарный знак. Дана характеристика принципов исчерпания исключительного права на товарный знак. Анализируется история развития законодательства Республики Беларусь и Российской Федерации об исчерпании исключительных прав на товарный знак, а также судебная практика, международные договоры и соглашения, касающиеся исследуемой темы. Определены принципы исчерпания исключительного права на товарный знак, применяемые государствами на соответствующих этапах развития законодательства о товарных знаках. Аргументируется целесообразность применения в отношении отдельных видов товаров международного принципа исчерпания исключительного права на товарный знак.

The article examines the prerequisites, peculiarities and development prospects of the legislation of the Republic of Belarus and the Russian Federation on the exhaustion of the exclusive right to a trademark. The principles of exhaustion of the exclusive right to a trademark are characterized. The history of the development of the legislation of the Republic of Belarus and the Russian Federation on the exhaustion of the exclusive rights to trademarks is analyzed, as well as the court practice, international treaties and agreements related to the subject under study. The principles of exhaustion of the exclusive right to a trademark applied by the states at the corresponding stages of the development of trademark legislation are identified. The expediency of application of the international principle of exhaustion of the exclusive right to a trademark with respect to certain types of goods is substantiated.
