Abstract: Исследуется правовая природа арбитражного соглашения. Выявляются и обобщаются проблемы реализации права субъектов на разрешение спора в арбитражном порядке. По результатам исследования автор определяет дефиницию «арбитражное соглашение» и формулирует ее характерные черты.
The article examines the legal nature of the arbitration agreement. The problems of realization of the right of subjects to dispute settlement in arbitration are identified and generalized. Based on the research findings, the author gives a definition of “arbitration agreement” and formulates its characteristic features.
