Развитие правового регулирования фактических брачных отношений

Abstract

Исследуются вопросы возникновения, развития, соотношения понятий «фактические брачно-семейные отношения», «гражданский брак», «сожительство», правовое регулирование имущественных и личных неимущественных прав и обязанностей участников фактических брачных отношений в Республике Беларусь и зарубежных странах, обосновывается необходимость дополнительной правовой регламентации фактических брачно-семейных отношений в нашей стране с целью обеспечения реализации имущественных и личных неимущественных прав и обязанностей их участников. Предлагается дополнить Кодекс Республики Беларусь о браке и семье статьей о фактических брачных отношениях и узаконить соглашение, определяющее имущественные и личные неимущественные права и обязанности участников фактических брачных отношений в фактическом браке и (или) в случае его расторжения.

The article discusses the issues of emergence, development, correlation be-tween the concepts of «actual marriage and family relations», «civil marriage», «cohabitation», legal regulation of property and personal non-property rights and obligations of participants in actual marriage relations in the Republic of Belarus and foreign countries; the necessity of additional legal regulation of actual marital and family relations in the Republic of Belarus in order to ensure the realization of property and personal non-property rights and obligations of participants is substantiated. It is proposed to supplement the Marriage and Family Code with an article on actual marital relations and legalize an agreement defining property and personal non-property rights and obligations of participants in actual marital relations in an actual marriage and (or) in case of its dissolution.
