Развитие правового регулирования фактических брачных отношений

Abstract

Исследуются вопросы возникновения, развития, соотношения понятий «фактические брачно-семейные отношения», «гражданский брак», «сожительство», правовое регулирование имущественных и личных неимущественных прав и обязанностей участников фактических брачных отношений в Республике Беларусь и за¬рубежных странах, обосновывается необходимость дополнительной правовой регламентации фактических брачно-семейных отношений. Предлагается дополнить Кодекс о браке и семье (КоБС) статьей о фактических брачных отношениях и узаконить соглашение, определяющее имущественные и личные неимущественные права и обязанности участников фактических брачных отношений в фактическом браке и (или) в случае его расторжения.

The article discusses issues of emergence, development, the relationship between the notions of «actual marriage and family relations», «civil marriage», «cohabitation», legal regulation of property and personal non-property rights and obligations of participants in actual marriage relations in the Republic of Belarus and other countries; the necessity of additional legal regulation of actual marital and family relations is substantiated. It is proposed to supplement the Marriage and Family Code with an article on actual marital relations and legalize an agreement defining property and personal non-property rights and obligations of participants in actual marital relations in an actual marriage and (or) in case of its dissolution.
