О медиабельности наследственных споров

Abstract

Статья посвящена критическому анализу проблемы применения медиации к разрешению споров, вытекающих из наследственных правоотношений. Сделан вывод о том, что спор может быть урегулирован с использованием медиации только в том случае, если характер этого спора допускает несколько вариантов разрешения, т.е. если отношения между участниками спора не урегулированы императивной нормой.

Devoted to a critical analysis of the problem of the application of mediation to the resolution of disputes arising from hereditary legal relations. It is concluded that the dispute can be settled using mediation only if the nature of this dispute allows for several options for resolution, that is, if the relationship between the parties to the dispute is not settled by a peremptory norm.
