The legal principles of the adoption institute in China have undergone a fundamental transition over more than half a century of evolution – from a subordinate position to an independent status, and from a family-centered model to a child-centered one. During the period of the 1950 and 1980 Marriage Law of the People´s Republic of China (hereinafter referred to as the Marriage Law), adoption was governed by the general provisions of marriage legislation. The 1991 Adoption Law of the People´s Republic of China (hereinafter referred to as the Adoption Law) for the first time independently established the principles of adoption. These adoption principles were further developed in the 2020 Civil Code of the People´s Republic of China (hereinafter referred to as the Civil Code). The Civil Code established «the best protection of the interests of the adoptee» as the priority principle of adoption. This article examines the formation and content of this principle, and substantiates and formulates proposals for introducing amendments to the legislation.
