Abstract: Анализируется международный опыт поведенческого надзора, исследуются его сущность, формы, методы, инструменты и выявляются наиболее современные его практики. Методологическую основу работы составили положения поведенческих финансов. Рассматриваются сущность и способы организации поведенческого надзора, выделены три его основные формы: проактивная, защитная и реактивная, проанализирован опыт практического применения инструментов надзора, соответствующих каждой из его форм. Сделаны выводы о надзорной деятельности в сфере защиты прав потребителей финансовых услуг в странах ЕАЭС. На основе анализа зарубежного опыта сформулированы направления совершенствования деятельности по обеспечению прав потребителей финансовых услуг в странах ЕАЭС, включающие формирование целей поведенческого надзора, отвечающих задачам развития финансового рынка, и построение системы инструментов, направленной на повышение институционального доверия населения. Впервые предложена трехуровневая система целей поведенческого надзора (оперативные, тактические, стратегические) и дополнена система количественных индикаторов для оценки его результативности, включающая уровень институционального доверия и инфляционных ожиданий, динамику долгосрочных сбережений граждан. Сделан вывод о необходимости унификации поведенческого надзора в странах ЕАЭС.
The article is devoted to the theoretical foundations of behavioural supervision, analysing its essence, methods and instruments. The relevance of the topic is driven by the importance of ensuring fair conditions for consumers of financial services, as well as by factors such as the digitalisation of the financial market, increasing competition and the emergence of complex financial products. The methodology of behavioural supervision is still in the making, and the accumulated foreign experience of its application remains insufficiently studied in the economic literature. The aim of the study is to analyse international experience in behavioural supervision, examine its essence, forms, methods, instruments and identify its most advanced practices. The methodological basis of the work is formed by the principles of behavioural finance. The article examines the essence and ways of organising behavioural supervision, identifies its three main forms – proactive, protective and reactive – and analyses the practical application of supervisory instruments corresponding to each form. Conclusions are drawn on supervisory activities in the field of consumer protection of financial services in the EAEU countries. Based on an analysis of foreign experience, directions have been formulated for improving consumer protection in financial services within the EAEU countries. These include defining behavioral supervision objectives that align with the goals of financial market development, as well as establishing a system of instruments aimed at enhancing the institutional trust of the population. For the first time, a three level system of behavioural supervision objectives (operational, tactical, strategic) is proposed, and the system of quantitative indicators for assessing its effectiveness is supplemented with the level of institutional trust, the level of inflation expectations and the dynamics of long term household savings. The article concludes that it is necessary to harmonise behavioural supervision across the EAEU countries.
