Защита прав детей посредством изучения морального облика учителя

Abstract

Анализируются нормы законодательства Республики Беларусь, направленные на защиту прав детей посредством изучения морального облика учителя. Рассмотрено историческое формирование законодательства, направленного на защиту прав детей в правовом поле, как на национальном, так и на международном уровнях. Одним из основных постулатов взаимоотношений с детьми, который должен быть основой педагогики, воспитания и решительного устранения авторитарного стиля общения, выступает постулат по принципу «взрослый — ребенок», «учитель — ученик». С целью исключения негативных последствий предлагается внести изменения в Кодекс Республики Беларусь об образовании и закон Республики Беларусь «О правах ребенка» в части порядка трудоустройства педагогических работников в общеобразовательные учреждения. Предложено авторское изложение ст. 27-1 закона «О правах ребенка», а также внесение изменений в ст. 51 Кодекса Республики Беларусь об образовании.

The article analyzes the norms of the legislation of the Republic of Belarus, aimed at protecting the rights of children by studying the moral image of the teacher. The historical formation of the legislation targeting protection of children’s rights in the legal field, both at the national and international levels, is considered. One of the main postulates of relations with children, which should be the basis of pedagogy and upbringing as well as decisive elimination of authoritarian style of communication, is the postulate on the principle of «adult—child», «teacher—student». In order to exclude negative consequences, it is proposed to amend the Code of the Republic of Belarus on Education and the Law of the Republic of Belarus «On the Rights of the Child» regarding the procedure of hiring the teaching staff in comprehensive educational institutions. The author’s statement of article 27-1 of the law «On the Rights of the Child» is proposed, as well as amendments to Article 51 of the Code of the Republic of Belarus on Education.
