Строительная отрасль на современном этапе: актуальные тенденции и правовое регулирование

Abstract

Рассмотрены особенности правового регулирования строительной отрасли в современных условиях. В соответствии с целью исследования — определить задачи и направления развития правового регулирования в сфере строительства с учетом современных тенденций — автором с использованием диалектического, системного, а также методов анализа и синтеза были предложены направления совершенствования законодательства в данной области. Обозначена необходимость формирования правовых условий для внедрения новых технологий и инноваций в строительстве, обеспечивая при этом гибкость правовых норм, их способность реагировать на меняющиеся условия и современные требования и вызовы. Выявлена задача определения доктринальных подходов в направлении системы межотраслевого регулирования, в которых публично-правовой аспект будет акцентироваться на реализации механизмов взаимодействия субъектов строительных отношений, регламентации правовых и экономических стимулов, оптимизации административных процедур и расширении договорных возможностей участников строительных проектов.

The features of legal regulation of the construction industry in modern conditions are considered. The objective of the study is the determination of the tasks and directions of the development of legal regulation in the construction industry taking into account current trends. In accordance with this aim, the author, using dialectical, systemic methods, as well as analysis and synthesis,suggests directions for improving the legislation in the area concerned. The article outlines the necessity of the formation of legal conditions for the introduction of new technologies and innovations in construction while ensuring the flexibility of legal norms, their ability to respond to changing conditions and modern requirements and challenges. The task is identified to define doctrinal approaches in the direction of the system of inter-branch regulation, in which the public-law aspect will be focused on the implementation of mechanisms of interaction of subjects of construction relations, regulation of legal and economic incentives, optimization of administrative procedures, and expansion of contractual opportunities forconstruction projectparticipants.
