Организационно-тактические особенности деятельности следователя на рабочем и заключительном этапах проведения следственных действий с участием защитника

Abstract

Целью статьи является разработка практических рекомендаций по деятельности следователя на рабочем и заключительном этапах проведения следственных действий с участием защитника. Автором обосновывается актуальность обозначенной проблемы, в том числе приводятся сведения об отсутствии в Республике Беларусь комплексных исследований деятельности следователя в условиях участия защитника в расследовании. Приводятся результаты проведенного автором эмпирического исследования (анкетирования следователей и адвокатов) относительно причин возникновения конфликтов в ходе проведения следственных действий с участием защитника. Характеризуя деятельность следователя на заключительном этапе проведения следственного действия с участием защитника, автор особое внимание обращает на стадию оценки результатов следственного действия, которая включает оценку отдельных его компонентов: процессуального, технического, тактического и организационного. По результатам проведенного исследования даны соответствующие тактические рекомендации для следователя, актуальные для применения на названных этапах проведения следственного действия с участием защитника.

The objective of the article is to develop practical recommendations for investigator’s activities at the working and final stages of investigative actions with the participation of a defense lawyer. The author substantiates the relevance of the problem, including information about the absence in the Republic of Belarus of comprehensive studies of the investigator’s activities in the context of the participation of the defense attorney in the investigation. The results of the empirical research conducted by the author (questionnaire survey of investigators and lawyers) on the causes of conflicts in the course of investigative actions with the participation of defense lawyer are presented. Describing the activities of the investigator at the final stage of the investigative action with the participation of the defense attorney, the author pays special attention to the stage of assessing the results of the investigative action, which includes the assessment of its individual components: procedural, technical, tactical and organizational. Based on the results of the study, appropriate tactical recommendations for the investigator are given, relevant for use at the named stages of the investigative action with the participation of the defense attorney.
