Понятие и признаки фактического брака: зарубежный опыт

Abstract

Рассматриваются вопросы возникновения, развития, соотношения понятий «фактические брачно-семейные отношения», «гражданский брак», «сожительство», проблемы правового регулирования имущественных и личных неимущественных прав и обязанностей участников фактических брачных отношений в Республике Беларусь и зарубежных странах, обосновывается необходимость дополнительной правовой регламентации фактических брачно-семейных отношений в Республике Беларусь с целью обеспечения реализации имущественных и личных неимущественных прав и обязанностей их участников.

The article discusses the issues of emergence, development, correlation of the concepts of «de facto marriage and family relationships», «civil marriage», «cohabitation», legal regulation of property and personal non-property rights and obligations of participants in de facto marriage relationships in the Republic of Belarus and foreign countries. The need for additional legal regulation of de facto marriage and family relationships in the Republic of Belarus is substantiated in order to ensure the implementation of property and personal non-property rights and obligations of their participants.
